More thoughts on bag searching

Technically, stun guns are illegal in NY State. I own 7 of them, and enjoy using them in SM scenes.

Should I still carry them?

No.

You could get arrested for carrying an illegal weapon, or worse.
With that many of them (not that you'd always carry that many) they could accuse of some master plot to take over the subways with stun guns.

I think that a good compromise would to just take a cab instead of the subway on the nights you think you're going to want to use them. You don't want to be the headline in the NYT "Man Arrested for Carrying Seven Stun Guns on Subway".

Given that an acquaintance was recently arrested trying to board a plane with a forgotten "weapon" that was illegal in the airport's jurisdiction, I'd strongly suggest you not carry them if there is a reasonable chance that you might get searched. I vote for taking a taxi or having someone who is driving or cabbing it deliver them for you.

I wouldn't carry anything illegal if you're going to be searched. You're putting yourself at risk when you do that. You're already going into the situation with a lot of unknowns because you will have weapons with you (even if they are legal). You need to think about all of the variables that will come into play when they go to search your bag. A lot of it will be dependent on the person who is searching it so you can't even guess there. What if they're not kink friendly? What if they are completely hard-nosed about weapons of any kind? If you add something illegal into that mix..

I'd take a taxi. I'd still think about whether or not I really want to carry the stun gun though. Just in case. Cautious is better than arrested :/

It's a class A misdemeanor if you're caught with one. I believe (someone please correct me if I'm wrong) the maximum punishment is a jail term of up to one year, and/or $1,000 in penalties.

I'd take a cab...

While also illegal (and perhaps a safety issue) - you could consider carrying it on your person - as, at least for now, they're not allowed to search *you* without probable cause. Tho one could argue that if you have a bag full of things they find "questionable" - they may decide its warranted.

Take the cab OR look into the laws on carrying the components of a stungun. For example, in MA (where I live) it is illegal to carry a firearm without the proper liscence, however it is not (I am told) illegal to carry the components of a firearm. If its possible to dissassemble the stun gun to some degree, it may be legal to carry the seperated components to the club/dungeon/whatever and put it back together there.

Ok what you do is sneak up on the station agent with ninja like stealth and pop em with your stun gun before they have a chance to search yourbag. Then with equal ninja like stealth you break out your disguises and switch identities as you board the train so that when you leave at the next station they'll be looking for a different guy.

This i think is a fool proof plan, yeah go for it

I vote for carrying your least favorite, that way if it gets confiscated you won't be entirely heart-broken.

I'd say no. Keep in mind there are other things illegal as well many of us may carry to a night out. I also believe handcuffs that can only be opened with a key are illegal, I am not sure if it just NYC or all of NY state, unless you are LE or have the security guard certification.

The reports this AM that the subway searches had already led to one arrest mentioned that the guy arrested had been carrying a stun gun, among other items.

hmm.. well, this doesn't help your should i carry them or not question, but - if it's an issue of flight/travel, and you're headed down here - i sort of bought a couple after fantasm.. and i'm sure you'd be welcome to use them while you were down here. :)

some sadist turned me on to them..

Wow, what's the world coming to? As I read through the comments of so many people, it sinks in deeper and deeper how we are being impacted.

And I agree, don't give them a reason to give you a hard time with explicitly illegal things. The whole idea of taking public transportation to a play space is another world apart from my own- man I'd be a mess trying to ride home after playing...lol

But anyways,
It makes me think of something we have locally between the queer/kink community and the Portland Police, it's called the Sexual Minorities Round Table. I'm told it's great stuff, I've never felt like I could attend the meetings without causing issues for myself at work - but they discuss, and problem solve things that have potential for conflict. i.e., At this year's Pride festival, the conservative protestors got a court order to enter into the fenced festival area with their signs and the police worked with the community to diffuse any potential for violence, etc.

Is there something similar in your neighborhood? Is there a strong enough interest to start talking about how you could approach the law enforcement community to understand eachother a little more, so that when they do find a bag full of tricks on the subway they don't start calling us terrorists on the national news?

Your comment reminds me of a discussion I had with a defense attorney in one of my classes. I...insinuated some things about SM to her and her only response to me was "You cannot consent to assault in MA." Now, this is a woman who defends underage murderers, so she's pretty interesting. It is something to think about.

Whomever made the disassembled comment was on my wavelength. Is there any way you can transform the stun gun into something more innocuous? (I'm thinking of the bullets in the rabbit's foot keychain idea)
